Yes, a driver may use a prescribed drug if certain conditions are met. Drugs which are prohibited under the FMCSRs appear in 21 CFR 1308, Schedules of Controlled Substances. They are lists, or Schedules, of controlled substances, categorized as opiates, opiate derivatives, hallucinogenic substances, depressants.

The NYS DDP requires participants to complete a preliminary screening designed to identify risk factors for a substance abuse disorder. If a person is found to be at risk for a substance abuse disorder they are referred for a comprehensive clinical assessment and/or to treatment.

If a sample is taken, it will be via a urine test most likely. A hair test (for ribonucleic assay test) is very involved and very expensive, and inappropriate for this type of screening. Depending upon the drug in question, you may or may not have flushed it out prior to the test. Also, one must be careful not to ingest certain foods which will cause a false positive, e.g. eating a bagel with poppy seeds.
